HIBOO PRIVACY AND COOKIE POLICY

The charter below details the policy of Hiboo Systems SAS, a simplified joint stock company with a capital of 54,265.40 euros, registered in the Paris Trade and Companies Register under the number 828 542 803 and whose registered office is located at 17 rue Boulard, 75014 Paris ("Hiboo") with respect to personal data on the website www.hiboo.io (hereinafter referred to as the “Site”).

For the purposes of the applicable legislation on the protection of personal data, the term “Personal Data” means any information relating to an identified or identifiable natural person, whether directly or indirectly (e.g., first and last name, date of birth, etc.) (“Personal Data”). The data controller is Hiboo.

This Policy applies to all Personal Data provided by users of www.hiboo.io to Hiboo.

1. INFORMATION COLLECTED

Hiboo may collect Personal Data when you sign up for our newsletter, create an online account or subscribe to any Hiboo services on the Site.

Any Personal Data that you may transmit to Hiboo for the use of certain services is subject to the provisions of the French Law n° 78-17 Informatique et Libertés of January 6, 1978, and of the Regulation n°2016/679 on the Protection of Personal Data.

The information you provide to us

You may provide us with information about yourself by filling out forms on the Site or by corresponding with us by phone, email, or other electronic means. This includes information you provide to us when you create an account to use the Site (which is required to use certain services and features), subscribe to our newsletter or sign up for a subscription to Hiboo services via the Site. This information may include your name, gender, date of birth, address, telephone number, email address, and credit or debit card information. When you create an account to use the Site, you can view your Personal Data by sending a request to support@hiboo.io. If you forget your password, simply click on the "Forgot Password" link on the registration or login page, and an email containing a link and token will be sent to the email address you provided during registration.

The information we collect about you

During each of your visits, we may automatically collect the following data:

1. technical data, including the Internet Protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone, browser extension types and versions, operating system, and platform; and
2. data about your visit to the Site, including the length of time you spend on certain pages, your interactions with those pages and the methods you use to leave that page, and any telephone numbers you use to contact our customer service department.
2. USE OF YOUR PERSONAL DATA

We use Personal Data about you for the following purposes:

The information you provide to us

We will use this information for the following purposes:

1. Administration of the Site and performance of our contract with you: the information you provide allows us to (i) validate and track your subscription (order confirmation and subscription tracking); (ii) maintain your account; (iii) perform billing and auditing purposes; (iv) authentication and identity checks; (v) credit, debit, or other payment verification; (vi) manage outstanding payments; (viii) perform legal and administrative follow-up.
2. To provide customer service: we ask for your contact information, including your email address, phone number and subscription details, to answer questions you may have regarding the use of the Site and to provide you with subscription status and other customer support services, such as identifying your needs. To provide these customer support services, we may use your Personal Data for statistical and market analysis, case studies, and research and development by us or a third party we designate as a data processor. However, in doing so, your Personal Data will be anonymized for the use of this data by these third parties. They will not receive your name, address, e-mail address, or telephone number.
3. Direct marketing: We want to keep you informed about our services and invite you to special events to enhance your experience with us. We may use the information you provide and the information we collect about you to build a profile of your interests so that we can tailor our communications to make sure they are relevant and interesting to you and when you visit our site, we can customize your experience to make it easier for you to shop with us.
4. Electronic marketing: If you are already one of our customers, we will only contact you by electronic means (e-mail or SMS) to present you with services like those you have already acquired. Otherwise, we will only contact you electronically if you have explicitly consented. If you are a new customer and we allow specific third parties to use your data, we (or they) will only contact you electronically if you have explicitly given your consent.
5. Other types of marketing: We will only contact you by mail or telephone if you have given your consent.

Opting Out of Marketing: You may opt out of receiving electronic or postal marketing materials at any time according to the terms of this Privacy Policy.

The Personal Data we collect about you

We will use this information for the following purposes:

6. Administration of the Site: to administer the Site and manage its internal operations, including troubleshooting, data analysis, testing, research, statistics, and surveys. We may collect and analyze Personal Data from visitors to the Site to build a profile of how visitors use the Site. This helps us to improve the service we offer you.
7. Site improvements: to improve the Site to ensure that its content is presented in the most effective manner for you and your computer;
8. Security of the Site: as part of our commitment to ensuring the security of the Site.
3. RIGHTS OF THE PERSONS CONCERNED

As a data subject and in accordance with applicable laws, you have the following rights:

1. Right of access to a copy of the information contained in your Personal Data that we store and use;
2. Right to object to processing that is likely to cause or that causes harm;
3. Right to object to processing for direct marketing purposes;
4. Right to rectify, block, erase or destroy inaccurate personal data; and
5. Right to claim compensation for damages caused by a violation of applicable laws.
4. DATA RETENTION AND DESTRUCTION

We retain Personal Data for as long as necessary to provide the Services to you and others and if we are legally required to do so. Information associated with your account will be retained until your account is deleted, unless we no longer need the data to provide the services, or until any legal obligation to retain it no longer exists. When we no longer need the Personal Data, we will securely delete and destroy it.

5. ACCESS, MODIFICATION, AND DELETION OF YOUR DATA

Your right of access may be exercised in accordance with applicable laws. We will respond to your request for access within one month in accordance with the law. Subject to applicable laws, you also have the right to update and correct inaccuracies in your Personal Data, and to block or delete it, as appropriate. You may change your Personal Data by accessing "My Account" or by requesting to change or delete your Personal Data by sending an e-mail to contact@hiboo.io  or by writing to us at the following address

You may also complain about or prevent the use of your Personal Data for purposes other than those for which it was originally collected by contacting us at the above-mentioned e-mail address or postal address.

6. DATA STORAGE AND SECURITY

The data we collect from you may be transferred to and stored in a country other than the country in which it was originally collected. This may include transfers outside the European Economic Area (EEA). This is because some of the operations that need to be performed to fulfill our contract with you are located outside the EEA. For example, Personal Data may be processed by persons who work for us or one of our service providers outside the EEA. These persons may be involved in processing your payment and providing administrative services. By submitting your Personal Data to us, you consent to their transfer, storage, or processing. We will take all steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this Privacy Policy and applicable law.

If we transfer Personal Data to a country outside the EEA, we will ensure that we apply one of the following appropriate safeguards:

1. The receiving party of the data is in a country recognized by the European Commission as offering an adequate level of data protection as established by the European Commission in accordance with Directive 95/46/EC or by the General Data Protection Regulation;
2. The party receiving the data has agreed to process the data in accordance with the "standard contractual clauses" for data controllers or data processors approved by the European Commission.

We use industry-standard encryption technology to ensure that all transaction information is protected with the highest level of security. This information includes credit card or payment information and your contact information. If you have consented prior to the entry of your subscription information, the Site will retain your account information such as your name, address, email address and order history. If we have provided you with a password (or if you have set one) that allows you to access certain parts of the Site, you are responsible for maintaining its confidentiality. We ask that you do not share it with anyone.

7. COOKIES

When consulting the Site, information relating to Web navigation on your computer, tablet, smartphone, or other electronic device (herein after referred to as Device) on the site may be recorded in data files (hereinafter referred to as "Cookies"). These Cookies are saved on your Device.

When you connect to the Site, a banner appears at the bottom of the screen. This banner informs you of the identity of the person responsible for processing your data, and of the length of time the said data is kept. It also allows you to set the parameters of the Cookies.

Indeed, we may install, subject to your choices, various Cookies in your Device allowing us to recognize the browser of your Device during the validity of the Cookie concerned. The Cookies we issue are used for the purposes described below, subject to your choices, which result from the settings of your browser software used when you visit our site.

Only the sender of a Cookie can read or modify the information contained in it.

The Cookies we issue allow us to:

1. establish statistics and volumes of frequentation and use of the various elements composing the Site (sections and contents visited, itinerary), allowing us to improve the interest and the ergonomics of our services;
2. adapt the presentation of the Site to the display preferences of your Device (language used, display resolution, operating system used, etc.) during your visits to the Site, according to the hardware and software for viewing or reading that your device uses;
3. memorize information relating to a form that you have filled out on the Site (registration or access to your account) or to services or information that you have chosen on the Site (subscribed service, etc.);
4. allow you to access reserved and personal areas of the Site, such as your account, thanks to identifiers or data that you may have previously entrusted to us;
5. implement security measures, such as when you are asked to log in to a service again after a certain period.

Some of the Cookies used on the site do not require your permission, such as those used for :

The issuance and use of Cookies by third parties is subject to the privacy policies of those third parties. We will inform you of the purpose of the Cookies we are aware of and how you can make choices about them.

You have several options for managing Cookies. You can choose at any time to express and modify your wishes regarding Cookies, by the means described below.

On our site, and as soon as you connect, a banner appears. On this one you find :

8. a summary of the purposes for which Cookies are used;
9. a list of our partners who may use Cookies on our site;
10. redirection links to the Cookie settings section.

On this last point, several options are proposed to you:

12. refuse all Cookies;
13. configure Cookies individually. If you select the latter option, each Cookie will be presented to you with its purpose, and you will be able to define which ones you want to use or not.

If you do not choose this option, no Cookies will be saved on your Device.

Your choices will be kept for one year. After this period, the banner will reappear on the site page, and you will again be asked to set Cookies.

You can also configure your browser software so that Cookies are saved in your Device or, on the contrary, that they are rejected, either systematically or according to their sender. You can also configure your browser software so that you are offered the option of accepting or rejecting Cookies from time to time before a Cookie is likely to be saved in your Device.

The recording of a Cookie in a Device is essentially subject to the will of the Device user, which he or she can express and modify at any time and free of charge through the choices offered by his or her browser software. If you have accepted in your browser software the recording of Cookies in your Device, the Cookies integrated in the pages and contents that you have consulted may be stored temporarily in a dedicated space in your Device. These Cookies will only be readable by their sender.

If you refuse to allow Cookies to be saved on your Device, or if you delete those which are recorded there, you will no longer be able to benefit from a certain number of functionalities which are nevertheless necessary to navigate in certain areas of the Site. This would be the case if you tried to access our content or services that require you to be identified. This would also be the case if we or our service providers were unable to recognize, for technical compatibility purposes, the type of browser used by your Device, its language and display settings or the country from which your Device appears to be connected to the Internet.

Each browser has a different configuration for managing Cookies and your choices. It is described in the help menu of your browser, which will allow you to know how to modify your wishes regarding Cookies.

If your Device is used by several people and when the same Device has several browsers, we cannot be sure that the services intended for your Device correspond to your own use of this Device and not to that of another user of this Device. Where applicable, the sharing with other people of the use of your Device and the configuration of the parameters of your browser about Cookies are your free choice and your responsibility.

Subject to mandatory legal provisions, Hiboo shall not be liable in any manner whatsoever for the alteration or impossibility to access, browse and/or benefit from the functionalities and services of the Site, resulting from the choices made by the Users in relation to Cookies.
